It is our policy to respond to clear notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws.

This page outlines the official procedure for submitting a notification of claimed infringement and a counter-notification if you believe material was mistakenly removed.

1. Reporting Copyright Infringement (DMCA Takedown Notice)

If you are a copyright owner or an agent thereof and believe that any content on the ChronicleNow.co.uk website infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our designated Copyright Agent with the following information in writing (see 17 U.S.C. § 512(c)(3) for detail):

A. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works on the site.
B. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide the specific URL(s) of the webpage(s) where the allegedly infringing material appears.
C. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
D. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
E. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
F. Your physical or electronic signature (full legal name required).

Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. We may share the information in your notice with the alleged infringer.

2. Submitting Your DMCA Notice

Your DMCA notice must be sent to our designated Copyright Agent at the following address:

Upon receipt of a valid, complete DMCA notice, we will act expeditiously to remove or disable access to the allegedly infringing material and notify the user who posted the content.

3. Counter-Notification (If Your Content Was Removed)

If you believe that material you posted on the site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification pursuant to Sections 512(g)(2) and (3) of the DMCA.

To be effective, your counter-notification must be a written communication sent to our Copyright Agent that includes substantially the following:

A. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
B. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
C. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to jurisdiction in the United Kingdom), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
D. Your physical or electronic signature (full legal name required).

4. Process After a Counter-Notification

Upon receipt of a valid counter-notification, we will promptly forward it to the party who submitted the original DMCA notice. If the original claimant does not notify us within 10 business days that they have filed a court action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on our site, we may replace or cease disabling access to the material.

5. Repeat Infringers

It is our policy, in appropriate circumstances and at our sole discretion, to disable and/or terminate the accounts of users who are repeat infringers of intellectual property rights.
